These Terms of Use, together with any additional terms presented in the app, form an agreement between you and Daven Gomes trading as VinylBox (“VinylBox”, “we”, “us”, or “our”).

Please read these Terms carefully before using VinylBox. By downloading, accessing, or using VinylBox, you agree to these Terms.

If you do not agree to these Terms, do not use VinylBox.

1. Who we are

VinylBox is operated by:

Daven Gomes trading as VinylBox
Unit 137633, PO Box 7169
Poole, BH15 9EL
United Kingdom
Email: contact@vinylbox.app

2. What VinylBox does

VinylBox helps users catalogue, organise, scan, value, and manage vinyl records, CDs, cassettes, and other music-related items.

Depending on the features you use, VinylBox may allow you to:

  • scan barcodes;
  • scan album covers;
  • identify albums or releases;
  • catalogue your collection;
  • manage folders, tags, notes, and collection metadata;
  • connect to Discogs;
  • sync with Discogs;
  • manage Discogs collections, wantlists, inventory, listings, orders, and messages through the Discogs API;
  • use subscription features;
  • export collection data in the app;
  • use public or shareable collection/profile features if we offer them.

Some features require an account, an active subscription, a Discogs account, an internet connection, or access to third-party services.

3. Age requirements

VinylBox is not intended for children under 13.

If you are under 13, you must not use VinylBox. If you are under the age of majority in your country or region, you should use VinylBox only with permission from a parent or guardian.

4. Apple App Store terms

If you downloaded VinylBox from the Apple App Store, the following terms apply.

These Terms are between you and Daven Gomes trading as VinylBox, not Apple. Apple is not responsible for VinylBox or its content.

We grant you a limited, non-transferable licence to use VinylBox on Apple-branded products that you own or control, as permitted by Apple’s Media Services Terms and Usage Rules, including any applicable Family Sharing or volume purchase rules.

We are responsible for providing any maintenance and support for VinylBox as described in these Terms or required by applicable law. Apple has no obligation to provide maintenance or support for VinylBox.

If VinylBox fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price for VinylBox where applicable. To the maximum extent permitted by law, Apple has no other warranty obligation for VinylBox.

We, not Apple, are responsible for addressing claims relating to VinylBox or your use of VinylBox, including product liability claims, legal or regulatory claims, consumer protection claims, privacy claims, or claims that VinylBox infringes third-party intellectual property rights.

You represent and warrant that you are not located in a country that is subject to a United States government embargo or designated by the United States government as a “terrorist supporting” country, and that you are not listed on any United States government list of prohibited or restricted parties.

You must comply with applicable third-party terms when using VinylBox.

Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple has the right to enforce these Terms against you as a third-party beneficiary.

5. Accounts

Some VinylBox features require an account.

VinylBox may support anonymous, session-based, or temporary account states before full account creation. Anonymous or session-based accounts may not provide permanent storage or cross-device sync.

For full account features, VinylBox may require account creation through Sign in with Apple or another authentication method we support in the future.

You are responsible for keeping your device, Apple account, Discogs account, and any account credentials secure.

You must provide accurate information where required and must not impersonate another person or create an account for someone else without permission.

We may suspend, restrict, or terminate access to VinylBox if we reasonably believe that you have violated these Terms, misused the service, created risk for other users or VinylBox, or used VinylBox unlawfully.

6. Discogs integration

Discogs connection is optional. Some VinylBox features require a Discogs account and your authorisation for VinylBox to access Discogs through the Discogs API.

If you connect Discogs, you authorise VinylBox to access, retrieve, display, manage, sync, and update Discogs information as needed to provide the Discogs-connected features you choose to use. This may include your Discogs profile, collection, wantlist, folders, inventory, listings, orders, messages, marketplace information, and related metadata.

VinylBox may store your Discogs access token and secret so the app can continue to provide Discogs-connected features. You can disconnect Discogs in VinylBox. When you disconnect Discogs, VinylBox deletes the Discogs access token and secret stored by VinylBox.

Disconnecting Discogs does not delete your Discogs account or any data held by Discogs.

VinylBox is not Discogs. Discogs is a separate service with its own terms, privacy policy, account system, marketplace rules, and data practices.

Discogs controls your Discogs account and data held by Discogs. If your collection, wantlist, listings, orders, messages, marketplace history, or other information is stored by Discogs, you must manage or delete that information through Discogs.

VinylBox is not responsible for Discogs’ services, API availability, data accuracy, account actions, marketplace rules, marketplace decisions, outages, changes, removals, restrictions, or data retention.

7. Discogs seller and marketplace features

VinylBox may allow Discogs sellers to view, create, edit, manage, or respond to Discogs listings, inventory, orders, and messages through the Discogs API.

VinylBox does not operate the Discogs marketplace. VinylBox is not a marketplace, seller, buyer, broker, auctioneer, payment processor, fulfilment provider, escrow provider, tax adviser, or party to any Discogs transaction.

Any sale, purchase, payment, refund, tax, shipping, grading, listing, condition description, buyer communication, seller communication, dispute, or marketplace issue is between the relevant Discogs users and/or Discogs.

You are responsible for ensuring that any Discogs listings, descriptions, prices, shipping terms, condition grades, messages, and transactions you create or manage through VinylBox are accurate, lawful, and comply with Discogs’ terms and policies.

You should verify important marketplace information directly with Discogs before relying on it.

8. Collection data

VinylBox may allow you to store collection data with VinylBox, sync or query collection data from Discogs, or use a combination of both.

If you use VinylBox without Discogs sync, your collection data may be stored by VinylBox using our backend providers.

If you use Discogs sync, your collection may be stored by Discogs, queried from Discogs, cached by VinylBox, or stored in part by VinylBox to provide sync, display, search, backup, or app features.

Sync may not be instant, complete, or error-free. You should verify important collection, listing, order, price, value, condition, shipping, and marketplace information before relying on it.

VinylBox is not responsible for loss of data caused by Discogs, third-party services, user error, device issues, account deletion, API changes, outages, or circumstances outside our reasonable control.

9. Album scanning, image analysis, and matching

VinylBox may allow you to scan album covers, take photos, or choose photos from your device to help identify albums or releases.

Album-cover scanning is provided for convenience. Matching may be inaccurate, incomplete, delayed, unavailable, or may identify a different release, edition, pressing, country, format, or variant.

You should check the result before adding an item to your collection, relying on value information, creating a listing, selling an item, or making any decision based on a match.

When you use album-cover scanning, the photo you provide may be processed by VinylBox and service providers for image analysis, safety checks, and matching. Photos submitted only for scanning are not stored after processing. If you use VinylBox without Discogs sync, VinylBox may store a private cover image for items in your collection so your collection can be displayed in the app.

You must not upload images or other content that is illegal, harmful, abusive, exploitative, sexually explicit involving minors, hateful, threatening, infringing, invasive of privacy, or otherwise unlawful or prohibited.

We may use automated checks to detect, block, or reject images or content that appear to violate these Terms or applicable law.

We may suspend or restrict access to scanning or account features if we reasonably believe they are being misused.

10. User content

“User Content” means information, data, images, photos, notes, tags, comments, collection entries, lists, profile information, messages, support attachments, and other content that you submit, upload, create, store, or share through VinylBox.

You keep ownership of your User Content.

You grant VinylBox a limited, worldwide, non-exclusive, royalty-free licence to host, store, copy, process, transmit, display, modify, resize, analyse, and use your User Content as needed to provide, operate, secure, support, and improve VinylBox and the features you choose to use.

You are responsible for your User Content. You must have the rights needed to upload, store, share, or use it through VinylBox.

You must not submit User Content that violates law, infringes intellectual property rights, violates privacy rights, contains malware, or violates these Terms.

We may remove, restrict, or refuse to process User Content if we reasonably believe it violates these Terms, creates risk, or is unlawful.

11. Public and shareable features

VinylBox may offer optional features that allow you to make parts of your collection, profile, lists, or listings public or shareable.

You are responsible for any information you choose to make public or share through VinylBox.

Do not share information publicly unless you are comfortable with other people seeing it. Public or shared information may be copied, indexed, saved, or redistributed by others.

We may remove or restrict public content if we reasonably believe it violates these Terms, infringes rights, creates risk, or is unlawful.

12. Subscriptions, purchases, and paid features

VinylBox may offer subscriptions, trials, introductory offers, promotional offers, or other paid features.

Purchases are handled through Apple’s in-app purchase system. Payment is charged to your Apple account.

Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current subscription period, or as otherwise described by Apple at the time of purchase. Your Apple account may be charged for renewal within 24 hours before the end of the current period.

You can manage or cancel subscriptions through your Apple account or App Store settings.

Prices may vary by country, currency, subscription plan, offer, promotion, eligibility, tax, exchange rate, or Apple’s App Store settings.

VinylBox uses RevenueCat to help manage subscription offerings, entitlements, purchase status, and related subscription functionality.

Apple handles payment processing and refunds according to Apple’s terms and policies. We do not receive your full payment card details.

Cancelling a subscription does not automatically delete your VinylBox account. Deleting your VinylBox account does not automatically cancel your subscription. You must manage or cancel your subscription through Apple.

We may change the features included in free or paid plans from time to time. If we make material changes that affect paid features, we will handle them in accordance with applicable law and Apple’s rules.

13. Data export

VinylBox may allow you to export your collection data in the app.

Export features may vary depending on whether your collection is stored by VinylBox, stored by Discogs, synced with Discogs, or available through a third-party service.

We do not guarantee that every item of data, image, metadata field, historical value, or third-party field will be exportable.

14. Account deletion

You can request deletion of your VinylBox account in the app.

When your VinylBox account is deleted, VinylBox deletes or anonymises the account information and collection data that VinylBox controls, including stored VinylBox collection data, private cover images stored by VinylBox, and Discogs access tokens stored by VinylBox, unless we need to retain limited information for legal, security, fraud-prevention, accounting, backup, or dispute purposes.

Deleted data may remain in encrypted backups for up to 60 days before those backups are overwritten or deleted in the ordinary course of business.

Deleting your VinylBox account does not delete your Discogs account, Discogs collection, Discogs wantlist, Discogs listings, Discogs inventory, Discogs orders, Discogs messages, Discogs marketplace history, or any other data controlled by Discogs. You must manage or delete those directly with Discogs.

Deleting your VinylBox account does not automatically cancel your Apple subscription. You must manage or cancel subscriptions through your Apple account or App Store settings.

15. Inactive accounts

If you use VinylBox without Discogs sync, or if you use an anonymous or session-based account, VinylBox may delete or anonymise your account and collection data after 180 days of inactivity.

“Inactivity” generally means that you have not opened the app, signed in, synced, scanned, edited your collection, or otherwise used VinylBox during that period.

Where we have a valid email address for you, we may send a notice before deleting inactive account data. We may not be able to contact anonymous users or users who have not provided an email address.

We do not intend to delete active paid subscription account data solely for inactivity while your subscription remains active, except where required for security, legal, operational, or abuse-prevention reasons.

16. Acceptable use

You agree not to:

  • use VinylBox unlawfully or fraudulently;
  • violate these Terms or third-party terms that apply to your use of VinylBox;
  • misuse Discogs integration or marketplace features;
  • upload illegal, harmful, abusive, exploitative, infringing, or privacy-invasive content;
  • attempt to access accounts, data, systems, or services without permission;
  • interfere with, disrupt, overload, scrape, reverse engineer, or misuse VinylBox or its infrastructure;
  • bypass subscription, security, rate limit, access control, or authentication systems;
  • use VinylBox to transmit malware, spam, or harmful code;
  • use VinylBox in a way that could harm VinylBox, other users, Discogs, service providers, or third parties.

We may suspend, restrict, or terminate access if we reasonably believe you have violated this section.

17. Third-party services

VinylBox may rely on or integrate with third-party services, including Apple, Discogs, RevenueCat, Supabase, analytics providers, crash reporting providers, advertising and attribution providers, image analysis providers, hosting providers, and other service providers.

Third-party services are not controlled by VinylBox. Their own terms, privacy policies, availability, pricing, data practices, and rules apply.

VinylBox is not responsible for third-party services, third-party data, API changes, outages, delays, restrictions, removals, inaccuracies, or decisions.

You must comply with any third-party terms that apply to your use of VinylBox.

18. Intellectual property

VinylBox, including the app, design, software, features, branding, logos, text, graphics, and other materials, is owned by us or our licensors and is protected by intellectual property laws.

These Terms do not transfer ownership of VinylBox or its intellectual property to you.

You may not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works from VinylBox except where expressly permitted by law or by us in writing.

Third-party names, logos, trademarks, album artwork, metadata, and content remain the property of their respective owners. VinylBox’s use of third-party data or integrations does not imply endorsement unless expressly stated.

19. Accuracy, availability, and changes

VinylBox may display collection data, Discogs data, album metadata, barcode results, album-cover matches, value information, price suggestions, marketplace information, subscription information, and other data.

We try to provide useful and accurate information, but we do not guarantee that VinylBox or any data shown in VinylBox will be accurate, complete, current, available, secure, uninterrupted, or error-free.

Album values, marketplace data, condition data, listing data, order data, release data, and match results may be inaccurate, delayed, incomplete, unavailable, or dependent on third-party services.

You are responsible for verifying important information before relying on it.

We may change, suspend, remove, or discontinue features from time to time. We may also impose limits on usage, storage, scanning, syncing, or access where reasonably necessary for security, performance, cost control, legal compliance, or product reasons.

20. Privacy

Our Privacy Policy explains how we collect, use, store, and share information. By using VinylBox, you acknowledge that we process information as described in the Privacy Policy.

21. Suspension and termination

You may stop using VinylBox at any time.

We may suspend, restrict, or terminate your access to VinylBox if we reasonably believe:

  • you violated these Terms;
  • you used VinylBox unlawfully or abusively;
  • your use creates risk for VinylBox, users, Discogs, service providers, or third parties;
  • we need to protect security, integrity, or availability;
  • we are required to do so by law or a third-party platform;
  • your account is inactive under these Terms.

Termination does not affect rights or obligations that by their nature should survive, including intellectual property, disclaimers, liability limits, payment obligations, dispute provisions, and terms relating to user content or data retention.

22. Disclaimers

VinylBox is provided on an “as is” and “as available” basis.

To the maximum extent permitted by law, we disclaim all warranties, representations, and conditions, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, accuracy, availability, security, non-infringement, and uninterrupted operation.

Nothing in these Terms excludes or limits any rights you have under applicable consumer law that cannot lawfully be excluded or limited.

23. Limitation of liability

Nothing in these Terms limits or excludes liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or your mandatory consumer rights.

To the maximum extent permitted by law, VinylBox will not be liable for indirect, incidental, special, consequential, punitive, or exemplary losses, or for loss of profits, revenue, business, goodwill, data, collection records, marketplace opportunities, or anticipated savings.

To the maximum extent permitted by law, VinylBox’s total liability arising out of or relating to VinylBox or these Terms will be limited to the greater of:

  • the amount you paid to use VinylBox in the 12 months before the event giving rise to the claim; or
  • £50.

This limitation does not affect rights that cannot lawfully be limited under applicable law.

24. Indemnity

If you use VinylBox for business, seller, marketplace, or commercial purposes, you agree to indemnify and hold VinylBox harmless from claims, losses, liabilities, damages, costs, and expenses arising from your misuse of VinylBox, your violation of these Terms, your User Content, your Discogs marketplace activity, your listings, your sales, your messages, your infringement of rights, or your violation of law.

If you are a consumer, this section applies only to the extent permitted by applicable law.

25. Changes to these Terms

We may update these Terms from time to time.

If we make material changes, we will take reasonable steps to notify you, such as by updating the app, posting a notice, or updating the “Last updated” date above.

Your continued use of VinylBox after updated Terms become effective means you accept the updated Terms, where permitted by law.

If you do not agree to updated Terms, you must stop using VinylBox.

26. Governing law and courts

These Terms are governed by the laws of England and Wales.

If you are a consumer living outside England and Wales, you may also have mandatory rights under the laws of your country or region, and nothing in these Terms limits those rights where they cannot lawfully be limited.

The courts of England and Wales will have jurisdiction, except that if you are a consumer you may be entitled to bring proceedings in your local courts where mandatory law allows.

27. General terms

If any part of these Terms is found to be invalid or unenforceable, the rest of the Terms will continue to apply.

Our failure to enforce a provision of these Terms does not mean we waive the right to enforce it later.

You may not transfer your rights or obligations under these Terms without our consent. We may transfer our rights or obligations where reasonably necessary as part of a business transfer, restructuring, merger, acquisition, sale of assets, or legal requirement.

These Terms, together with the Privacy Policy and any additional terms presented in the app, form the entire agreement between you and VinylBox for your use of VinylBox.
